EB-5 Alternatives:
E and L Visas

In my last blog post, I discussed the EB-5 program – invest $1M (or $500K) and you get a Green Card.  At least that’s the short of it.  The E and L visa classifications, on the other hand, are much more affordable options.

The E visa is for treaty traders and investors, and it is used by many foreign nationals with an entrepreneurial spirit.  The E visa allows a foreign national to go to the United States to work and live so long as they are a citizen of a country that has a Treaty of Commerce and Navigation (“TCN”) with the United States.  They must be going to America to carry on substantial trade or to develop and direct the operations of a U.S. enterprise in which they have invested.  The spouse of the principal beneficiary of the E visa is permitted to obtain employment authorization to work for any company in the U.S., and unmarried children under 21 have the opportunity to attend any U.S. school.  If properly planned, E visa holders could potentially obtain a Green Card.

Alternatively, foreign nationals can go to America to develop and direct the operations of an enterprise through the use of the L visa.  The L visa is a non-immigrant classification whereby companies may transfer employees working abroad to function in the same or similar capacity for the parent, subsidiary, branch, or affiliate company in the United States.  This visa also allows foreign nationals to establish new offices in America.  As long as there is a business currently operating abroad, it can be expanded into the U.S. by establishing and carrying on its operations under a U.S. company that is associated with the foreign enterprise.  Like E visa holders, those in L status can work and live in America.  Further, the spouse of the principal beneficiary in L status can also obtain unrestricted work authorization in the U.S. and unmarried children under 21 can attend any school, much like E visa holders.  Finally, certain persons holding L status are on a direct route to obtaining a Green Card.

Both the E and L visa classifications can be nice alternatives to the EB-5 if one doesn’t have $500K or $1M to invest.

Dans mon dernier billet de blogue, j’ai présenté le programme de visa EB-5 qui vous permet d’investir $1 million de dollars US (ou dans certains cas $500 000 de dollars USD) en échange d’une carte de résidence permanente, aussi appelée « Green Card » ou « Carte verte ». Les visas issus des catégories E et L sont pour leur part des options considérablement plus abordables.

Les visas issus de la catégorie E sont pour les négoçiants et les investisseurs, et ils sont obtenus par un important nombre d’immigrants animés d’un esprit entrepreneurial. Cette catégorie de visas permet à un étranger d’entrer aux États-Unis pour travailler et y vivre pourvu qu’il est resortissant d’un pays ayant conclu un traité de commerce et de navigation (ci-après « TCN ») avec les États-Unis. L’objectif de leur entrée aux États-Unis doit être l’un des deux objectifs suivants : (1) mener des activités liées un important commercie de produits ou de services ou (2) diriger une entreprise ou prendre en main son développement. L’époux du détenteur d’un visa de la catégorie E peut obtenir l’autorisation de travailler pour n’importe quel employeur aux États-Unis et les enfants non-mariés de moins de 21 ans ont l’opportunité d’étudier dans toute école américaine. Une bonne planification peut permettre au détenteur d’un visa de la catégorie E d’obtenir une carte de résidence permanente américaine.

Alternativement, un étranger peut entrer aux États-Unis pour développer et diriger les opérations d’une entreprise par le biais d’un visa issu de la catégorie L. Cette  catégorie de visa est une classification non-immigrante par laquelle une compagnie étrangère transfère des employés pour travailler dans un poste similaire ou identique au sein d’une entreprise-mère, une subsidiaire, une filiale ou une succursale aux États-Unis. En autant que la compagnie étrangère continue à opérer en dehors des États-Unis, elle peut étendre ses activités aux États-Unis en établissant une compagnie américaine associée pour mener ses activités aux États-Unis. Tout comme les déteneurs des visas de catégorie E, les détenteurs d’un visa de catégorie L peuvent travailler et vivre aux États-Unis. De plus, l’époux du détenteur d’un visa de catégorie L peut travailler sans restriction aux États-Unis et les enfants non-mariés de moins de 21 ans peuvent étudier dans toute école américaine. Finalement, certaines personnes qui détiennent un visa de catégorie L ont une voie directe pour obtenir une carte de résidence permanente américaine.

Les visas de catégorie E et L sont deux alternatifs intéressants à un visa EB-5 pour un individu qui n’a pas les avoirs pour investir $500 000 ou $1 million de dollars US.
